KUALA LUMPUR: “Deep In your heart, you alone know what happened and only you can tell the pain your child had suffered. So do repent,” Judge Datuk Azman Abdullah told a man who had pleaded guilty to sodomising, raping and sexually abusing his biological daughter.
The judge said the acts committed by the 37-year-old father was unacceptable by a human being as even animals do not commit such heinous acts.
He advised the man after allowing him to appeal against his 48-year prison sentence for 623 sexual offences, meted out by the Special Court for Sexual Crimes Against Children in Putrajaya on Sept 8, 2017.
For the 623 charges. Azman reduced the 48 years jail sentence to 40 years while retaining the total number of whippings of 24 strokes, imposed by the Sexual Crimes Court
Of the 623 offences, the appellant was convicted of 591 sodomy charges, 30 counts of physical sexual abuse by touching his eldest daughter, one charge of rape and one charge of sexual assault.
For each sodomy charge, the High Court reduced the 20-years jail sentence to 16 years, for the physical sexual abuse allegations the sentence was reduced from 20 years to 10 years and for the sexual assault charge it was reduced from 15 years to 10 years.
The court ordered the sentences to run concurrently. Thus the appellant will serve a 16-year jail term.
On June 1, Azman reduced the jail sentence for rape to 24 years from 28 years after allowing the man's appeal and the court ordered the appellant to serve the 16 years after he has completed the 24-year- jail term.
As such, the man will serve 40 years in jail while the orders which had been imposed on the appellant by the previous court were retained.
On Sept 8, 2017, the appellant was sentenced to 48 years' jail and 24 strokes after he pleaded guilty to 623 sexual offences against his 15-year-old daughter.
The court also ordered the appellant to undergo rehabilitation counselling for 10 years and be placed under police supervision for three years after serving the jail term.
He was further ordered to pay RM10,000 compensation to the victim or face another 12 months in prison.
The court also ordered that he be placed under a RM10,000 deposited bond of good behaviour with one surety, for five years, and do 240 hours of community work for six months.
